Terms & Conditions

These terms explain how orders, quotes, payment, delivery, revisions, and file ownership work when you use Ken Digitizing. Please read them before placing an order.

Section 01

Agreement to these terms

These Terms & Conditions (the “Terms”) govern your access to and use of the Ken Digitizing website at kendigitizing.com and the embroidery digitizing services we provide (together, the “Services”). By uploading a design, requesting a quote, or placing an order with us, you confirm that you have read, understood, and agree to be bound by these Terms.

If you are using the Services on behalf of a business, you confirm that you have the authority to bind that business to these Terms, and “you” refers to that business.

If you do not agree with any part of these Terms, please do not use the Services.

Section 02

Our services

Ken Digitizing converts artwork, logos, and images into machine-ready embroidery files. Every file is digitized manually by our team — we do not use auto-conversion software.

  • Embroidery and logo digitizing, including left chest, jacket back, and sleeve designs
  • Cap and hat digitizing, including 3D puff
  • Patch, appliqué, and emblem digitizing
  • Photo and live-image digitizing
  • Delivery in standard machine formats including DST, PES, EXP, JEF, and VP3

We deliver digital files only. We do not print, stitch, or ship any physical products, and we do not supply embroidery machines, thread, or garments.

Section 03

Placing an order and quotes

To place an order, upload your artwork through our order form along with your name, email address, and your requirements — file format, design size, stitch complexity, quantity, turnaround, and any special instructions.

The price shown on the order form is an estimate. Our team reviews every submission and confirms a final quote by email before work begins. No payment is taken at the time of upload.

An order is only accepted once we have confirmed the quote and you have approved it. We reserve the right to decline any order, including where the artwork is unclear, unsuitable for embroidery, or where accepting it would breach these Terms.

You are responsible for the accuracy of the information you provide. Incorrect sizes, formats, or fabric details may result in a file that does not stitch as expected, and corrections outside our error may be treated as a new order.

Section 04

Pricing and payment

Pricing depends on design size, stitch count, complexity, colour changes, quantity, and how quickly you need the file. Most designs fall between $10 and $40 per design, with expedited turnaround charged as an additional rush fee.

  • All prices are quoted and payable in US dollars (USD).
  • Quoted prices are exclusive of any taxes, duties, or bank and payment-processor fees that may apply to you.
  • Payment is due as stated on the invoice or quote we send you. We may hold delivery of final files until payment is received.
  • We accept major cards and the payment methods shown on our website; card payments are processed by third-party payment providers and we never store your full card details.

Quotes are valid for 30 days unless stated otherwise. We may update our published pricing at any time, but a confirmed quote will always be honoured for the order it relates to.

Section 05

Turnaround and delivery

Our standard turnaround is 4–12 hours from the time the quote is confirmed. Expedited service is available for delivery in 1–4 hours, subject to an additional fee and our current capacity.

Finished files are delivered digitally, by email to the address supplied with your order. It is your responsibility to provide a valid email address and to check spam or filtered folders.

Worth knowing

Turnaround times are targets, not guarantees. Complex artwork, poor-quality source files, incomplete instructions, delayed responses, or circumstances outside our reasonable control may extend delivery times. We will always tell you as soon as we know a design will take longer.

Section 06

Revisions

Free revisions are included with every order. If the delivered file does not match your approved requirements, tell us what needs changing and we will correct it at no cost.

  • Revision requests should be made within 30 days of delivery.
  • Where possible, send a stitch-out photo or a description of the issue so we can identify the problem quickly.
  • Revisions cover corrections to the file we produced against your original brief.
  • New requirements — a different size, a different fabric, added or removed elements, or a redesign — are treated as a new order and quoted separately.

Your artwork and intellectual property

You retain all ownership of the artwork, logos, trademarks, and other materials you send us. By submitting them, you grant Ken Digitizing a limited, non-exclusive licence to store, reproduce, and modify those materials solely for the purpose of producing your embroidery files and providing support.

You confirm and warrant that you own the artwork you submit, or that you have all necessary rights, licences, and permissions to have it digitized. You agree to indemnify Ken Digitizing against any claim, loss, or expense arising from a third-party allegation that your submitted artwork infringes their rights.

We may display anonymised samples of completed work in our portfolio or marketing materials. If you would prefer your design not to be shown, simply tell us and we will exclude it.

Section 08

Ownership of your digitized files

Once your order has been paid for in full, the embroidery file we produce is yours. You may use, modify, and stitch it without limit, for personal or commercial purposes.

We keep a backup of completed files free of charge so you can request a replacement copy if you lose the original. We cannot guarantee that backups will be retained indefinitely, so please keep your own copy of any file you rely on.

Until an order is paid in full, the file remains the property of Ken Digitizing and may not be used in production.

Section 09

Acceptable use

You agree not to use the Services to submit or request work that:

  • Infringes the copyright, trademark, or other rights of any third party
  • Is unlawful, defamatory, hateful, harassing, or promotes violence or discrimination
  • Is obscene or otherwise inappropriate for a general-audience business
  • Attempts to impersonate another person or organisation

You also agree not to interfere with, disrupt, probe, or attempt to gain unauthorised access to our website, servers, or systems. We may suspend or terminate access to the Services, without refund, where these Terms are breached.

Section 10

Confidentiality

We treat every design you send us as confidential. Your artwork is used only to fulfil your order, and it is not sold, licensed, or shared with any third party for their own purposes.

Access to submitted files is limited to the members of our team and the service providers who need it to deliver your order. If you require a signed non-disclosure agreement before sending artwork, contact us and we will be happy to arrange one.

Section 11

Cancellations and refunds

Cancellations, eligibility for refunds, and how refunds are processed are set out in full in our Refund Policy, which forms part of these Terms.

In short: we fix problems with free revisions first, and where a file cannot be made right we will refund it. Orders already completed and delivered as specified are generally not refundable.

Section 12

Disclaimers and limitation of liability

We take great care with every file, but embroidery results depend on factors we do not control — your machine, its calibration and tension, thread type, stabiliser, backing, and fabric. We cannot guarantee an identical stitch-out on every machine or material.

The Services and our website are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Ken Digitizing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, production time, or materials. Our total liability arising out of or relating to an order will not exceed the amount you paid us for that order.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Section 13

Third-party services and links

Our website and Services rely on third-party providers for hosting, file storage, analytics, and payment processing. Their handling of data is described in our Privacy Policy.

Our site may contain links to third-party websites. We are not responsible for the content, policies, or practices of any site we do not operate.

Section 14

Changes to these terms

We may update these Terms from time to time to reflect changes to our Services, our practices, or the law. The revised version takes effect as soon as it is posted on this page, and the “Last updated” date above will change.

The Terms that apply to your order are the ones in effect at the time the order is confirmed. Continuing to use the Services after an update means you accept the revised Terms.

Section 15

Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. You and Ken Digitizing agree to the exclusive jurisdiction of the courts located in Texas for any dispute arising out of or relating to these Terms or the Services.

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
